Terms and Conditions

These terms explain the rules for Heyy Studio accounts, Studios, Tools, credits, subscriptions and separately quoted Expert Production.

1. Agreement to these terms

These Terms and Conditions form an agreement between you and Heyy Studio, the operator of the Heyy Studio website and services. By creating an account, buying a plan or credits, requesting Expert Production or otherwise using the services, you agree to these terms and the policies linked from them.

  • If you use Heyy Studio for an organisation, you confirm that you are authorised to act for it.
  • If you do not agree, do not use the services.

2. Eligibility and account responsibility

You must be legally able to enter this agreement. If you are not able to do so on your own, a parent, guardian or authorised representative must approve and supervise your use.

  • Provide accurate account and billing information.
  • Keep your email account, sign-in methods and devices secure.
  • Do not share an account in a way that defeats access, plan or security controls.
  • Tell Heyy Studio promptly if you suspect unauthorised access.

3. Heyy Studio services

Heyy Studio provides a connected creative workspace that includes specialist Studios, focused Tools, project and file features, and a route to separately scoped Expert Production. Features available to you can depend on your plan, account status, device, location and the particular workflow.

4. Studios and Tools

Studios guide you through a structured project brief and connected outputs. Tools perform focused tasks such as generating or adapting media, creating presentations, processing PDFs or converting files.

  • Complete required setup accurately before generating.
  • Review the displayed cost and output description before confirming an action.
  • Regenerating or repeating a paid action creates a new result and normally uses credits again.

5. Credits

Credits are Heyy Studio usage units for eligible self-service actions. They are not money, stored value, a bank product or a transferable asset, and cannot be redeemed for cash.

  • The current credit cost is displayed in the product and Credit Guide.
  • Credits may be reserved while work is processing and committed after success.
  • A confirmed failed generation returns its credit reservation automatically.
  • Viewing or downloading existing work does not itself use generation credits unless the product clearly shows a charge.

6. Subscription credits and purchased credits

Subscription credits and purchased top-up credits are recorded separately. Subscription credits are used first.

  • Starter and Pro subscription credits refresh monthly, including on yearly subscriptions.
  • Unused subscription credits do not roll over and are replaced by the next monthly allowance.
  • Purchased credits do not expire, but remain subject to these terms, account access and lawful platform operation.
  • Deleting an account permanently removes its remaining credit balances.

7. Subscriptions, billing and renewal

Paid plans are billed in advance at the interval and price shown at checkout. Unless cancelled, a subscription renews automatically using the saved payment method. Yearly plans are billed yearly while subscription credits continue to refresh monthly.

  • Prices are shown in USD unless the checkout states otherwise.
  • Taxes and payment details are handled as shown at checkout and on the invoice.
  • A failed or overdue payment may pause subscription entitlements, cloud saving or future subscription-credit grants.
  • Plan or interval changes take effect as described in the Billing & plan area and checkout flow.

8. Cancellation

You can cancel future subscription renewal through Billing & plan and the secure billing controls provided there. Cancellation ordinarily takes effect at the end of the current paid period unless the cancellation flow states otherwise.

  • Cancellation stops future renewal; it does not automatically refund a charge already processed.
  • Cloud project and version access may move to the read-only grace or restricted state described in the account after paid access ends.
  • Refund rights under the Australian Consumer Law and other non-excludable laws are not affected.

9. Your uploads and content

You retain rights you hold in prompts, briefs, uploads and other original material you provide. You give Heyy Studio and its service providers permission to host, copy, process, transform and transmit that material only as reasonably needed to operate, secure and support the requested services.

  • Keep your own copies of important source files and completed work.
  • Do not upload unnecessary confidential, health, financial or other sensitive personal information.
  • Project and production records may be retained where needed for service delivery, billing, security or legal obligations.

10. Rights and permissions

You are responsible for having the rights, licences, permissions and consents needed for everything you submit or ask Heyy Studio to use. This includes copyright, trademarks, confidential information, personal information and a person's image or likeness.

11. Generated outputs

Subject to these terms and any third-party rights, you may use generated outputs for lawful purposes. Generated material can resemble existing material, may not be unique and is not guaranteed to qualify for intellectual-property protection.

  • Review outputs before publishing, selling, registering, printing, building or relying on them.
  • Heyy Studio does not guarantee originality, exclusivity, clearance or fitness for a particular purpose.
  • Third-party rights can continue to apply to your inputs, references and resulting outputs.

12. AI limitations

AI-assisted outputs can contain errors, omissions, artefacts, invented details, bias or unexpected content. They are creative assistance, not autonomous professional advice or a guarantee of factual, legal, technical or commercial correctness.

13. Architecture and Interior limitations

Architecture Studio and Interior Studio outputs are conceptual and for early design exploration. Unless a separately accepted Expert Production quote expressly provides otherwise, outputs are not surveys, permits, engineering, code or accessibility review, construction drawings, safety advice, quantity verification, procurement approval or installation documentation.

  • Qualified professionals must verify dimensions, structure, services, codes, materials, quantities and site conditions.
  • Do not order, fabricate or construct from an unverified concept output.

14. Acceptable use and Content Policy

You must use Heyy Studio lawfully and follow the Content Policy. You must not use the services to harm others, mislead people, infringe rights, compromise security or bypass platform safeguards.

15. Expert Network and Expert Production

The Expert Network is a curated project-based network. Applying does not create employment, activate an Expert Portal account or guarantee project work. An Expert Production request is an inquiry, not acceptance of work or authority to begin.

  • Heyy Studio may review, decline or ask to clarify a request.
  • Suitable work may be shared privately with selected Experts for scoping or quotation.
  • Heyy Studio manages the client relationship and production workflow for accepted work.

16. Expert Production quotes, scope and payment

If a request can proceed, Heyy Studio provides a separate quote describing the scope, price, currency, delivery estimate, included revisions and deliverables. The quote and any project-specific terms form part of the agreement for that work.

  • Review and accept the quote before payment.
  • Production normally begins after the required payment is confirmed.
  • Additional deliverables, revisions beyond the allowance or material scope changes may require a revised quote or add-on payment.
  • Cancellation and refund treatment follows the accepted quote, the Refund Policy and applicable law.

17. Intellectual property

Heyy Studio retains rights in its platform, software, visual system, workflows, documentation and branding. You must not copy, reverse engineer, resell or create an unauthorised competing service from protected platform materials.

  • You retain rights in your original inputs.
  • Rights in Expert Production deliverables are governed by the accepted quote and any stated licence or transfer terms.
  • Feedback may be used to improve the service without identifying you publicly.

18. Third-party services

Heyy Studio relies on third-party services for authentication, hosting, storage, payments, email, file processing and AI-assisted generation. Their availability, rules and processing can affect the service. You may also be subject to third-party terms when you use their features or content.

19. Availability and changes

Heyy Studio may maintain, improve, add, limit or retire features and providers. The service is not guaranteed to be uninterrupted, error-free or available in every place or on every device. Where practical, material changes affecting paid access will be communicated through the service or account contact details.

20. Suspension and termination

Heyy Studio may restrict or suspend access where reasonably necessary to address non-payment, unlawful activity, policy breaches, security risk, misuse or harm to the service or others. Serious or repeated breaches may result in termination.

  • Where appropriate, Heyy Studio may provide notice or an opportunity to correct the issue.
  • You remain responsible for charges and obligations incurred before suspension or termination.
  • Contact support if you believe action was taken in error.

21. Disclaimers

To the extent permitted by law, the services and generated outputs are provided on an as-available basis. Heyy Studio does not promise that an output will be unique, accurate, legally cleared, professionally approved, safe for every use or suitable for your specific project without review.

22. Liability

To the extent permitted by law, Heyy Studio is not responsible for indirect or consequential loss, lost opportunity or decisions made from unreviewed generated output. You are responsible for the way you use, publish or implement your inputs and outputs.

  • Any limitation applies only to the extent the law allows.
  • Nothing in these terms limits liability that cannot lawfully be limited or excluded.
  • Project-specific liability terms may also appear in an accepted Expert Production quote.

23. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, remedy or other right under the Australian Consumer Law or another law that cannot lawfully be excluded, restricted or modified. Where a remedy may lawfully be limited, Heyy Studio may choose an appropriate remedy permitted by law.

24. Changes to these terms

Heyy Studio may update these terms when services, business practices or legal requirements change. The updated date will be shown on this page. If a change is material, reasonable notice may also be provided through the service or account contact details. Continued use after the effective date means the updated terms apply, subject to applicable law.

25. Governing law

These terms are governed by the laws applicable in Victoria, Australia. You and Heyy Studio submit to the courts with jurisdiction in Victoria, while preserving any right you have to bring a claim in another forum under a law that cannot be excluded.
